Terms and Conditions of Ogarni.ai Service
Version 1.1, effective from January 10, 2026
1. General Provisions
- The Ogarni.ai Service (hereinafter: "Service") is a web application available at https://app.ogarni.ai, serving personal budget management. The Service Administrator is Isidore Software Jakub Matjanowski, with headquarters in Toruń, ul. Pawia 19, NIP: 9562286058, REGON: 364620516 (hereinafter: "Administrator").
- These Terms and Conditions specify the rules for using the Service, rights and obligations of Users and the Administrator, as well as conditions for providing electronic services.
- These Terms and Conditions constitute the regulations referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services.
- Using the Service requires acceptance of these Terms and Conditions. Lack of acceptance prevents registration and access to services.
- The Service operates on a freemium model: basic features are available for free, while extended features under Paid Subscription (Premium) require payment according to the Price List.
- In accordance with the provisions of Regulation (EU) 2022/2065 of the European Parliament and of the Council of October 19, 2022 on a single market for digital services and amending Directive 2000/31/EC (Digital Services Act, hereinafter: "DSA"), the Administrator has designated a contact point for direct communication with authorities of EU Member States, the European Commission, the Digital Services Board, and Service Users regarding matters covered by the DSA regulation. The contact point is available at: administrator@ogarni.ai.
- Before starting to use the Service, the User is obliged to familiarize themselves with these Terms and Conditions and the Privacy Policy.
- The Administrator reserves the right to change these Terms and Conditions for important reasons, such as legal changes or functional changes to the Service. Users will be notified of changes by email or through a message in the Service at least 7 days in advance.
2. Definitions
- Consumer: a natural person entering into a legal transaction with the Administrator not directly related to their business or professional activity.
- User: a natural person who has created an Account in the Service and uses its features.
- Account: an individual User profile in the Service, protected by a password, enabling the User to use the Service's functionality.
- Freemium: a model where basic features are free and extended features are available for a fee.
- Paid Subscription (Premium): a paid service providing access to advanced Service features.
- Loyalty systems: external platforms of major Polish store chains from which the Service retrieves purchase data with User consent.
- Non-conformity: non-compliance of the service of using the Service with the contract for its provision (criteria for assessing service conformity with the contract are specified in Article 43k(1)-(2) of the Consumer Rights Act).
- User Content: all data (including personal data), electronic files, information and materials saved by the User on the Account.
3. Technical Conditions and Registration
3.1. Technical Requirements
To use the Service, the following are necessary:
- A device with Internet access,
- An up-to-date web browser (e.g., Chrome, Firefox),
- An active email account.
3.2. Registration
To create an Account, the User provides:
- Email address,
- Password.
The User undertakes to provide true data and maintain password confidentiality.
The moment of concluding the service provision contract is the confirmation of registration by clicking the verification link sent to the provided email.
The Service also allows authentication through Google Sign-In (OAuth 2.0), in which case the User is not required to create a separate password for the Service. In this case, the authentication process is subject to the terms of service and privacy policy of Google LLC.
The Administrator may refuse registration or delete the Account in case of providing false data or violating these Terms and Conditions.
3.3. Conditions of Use
- The User must be at least 18 years old and have full legal capacity.
- Actions that disrupt the functioning of the Service or violate the rights of others are prohibited.
- Within the Service, Users are prohibited from using viruses, bots, worms or other computer codes, files or programs (in particular automated scripts and applications or other codes, files or tools).
- The Administrator informs that they use cryptographic protection of electronic transfer and digital content by applying appropriate logical, organizational and technical measures, in particular to prevent access by third parties to data, including through SSL encryption, using access passwords and antivirus or anti-malware programs.
4. Service Functionality
4.1. Basic Features (Free)
The Service in the free version enables:
- Manual expense management,
- Basic budget analysis,
- Scanning and categorizing receipts,
- Generating expense reports.
4.2. Premium Features
Paid Subscription provides access to:
- Advanced analysis and reports,
- Unlimited receipt scanning,
- Integration with store loyalty systems,
- AI assistant analyzing habits and trends.
4.3. Loyalty System Integration
The Service allows integration with loyalty systems of major Polish store chains. Data retrieval requires User consent and authentication in external systems. The Administrator does not store passwords to external systems.
4.4. AI Assistant
The AI Assistant analyzes User data to provide personalized financial tips. The User may opt out of this feature in Account settings.
5. Payments and Subscriptions
5.1. Price List
Current prices are available in the Service. The Administrator reserves the right to change prices, about which Users will be informed in advance.
5.2. Payment Methods
Payments are processed through external payment providers (e.g., Stripe). The Service does not store payment card data.
5.3. Withdrawal from Contract
A Consumer who has concluded a distance contract may withdraw from it within 14 days without giving reasons. The right to withdraw does not apply to the provision of digital content if the provision has begun with the Consumer's express consent.
5.4. Subscription Cancellation
The User may cancel the Premium subscription at any time. Access to Premium features lasts until the end of the paid period.
6. Personal Data and Privacy
6.1. Data Administrator
The Administrator of personal data is Isidore Software Jakub Matjanowski. Detailed information on data processing is contained in the Privacy Policy.
6.2. Data Security
The Administrator applies appropriate technical and organizational measures to protect personal data, including SSL encryption, access passwords, and regular security testing.
6.3. User Rights
The User has the right to:
- Access their data,
- Rectify data,
- Delete data,
- Limit processing,
- Data portability,
- Object to processing.
7. Liability
7.1. Administrator's Liability
The Administrator is liable for non-performance or improper performance of the service contract. In the case of Consumers, the provisions of the Consumer Rights Act apply.
7.2. Limitation of Liability
The Administrator is not liable for:
- Losses resulting from failure to comply with technical requirements,
- Incorrectness of data entered by the User,
- Breakdowns of the Service caused by force majeure.
7.3. User's Liability
The User is liable for providing false data and for actions that violate these Terms and Conditions or the rights of third parties.
8. Complaints
8.1. Filing Complaints
Complaints regarding the functioning of the Service may be submitted by email to administrator@ogarni.ai or in writing to the Administrator's address.
8.2. Complaint Processing
The Administrator will respond to the complaint within 14 days of its receipt. If the complaint is considered justified, the Administrator will remove the indicated irregularities.
9. Intellectual Property
9.1. Copyrights
All content available in the Service (graphics, texts, software) is protected by copyright and belongs to the Administrator or entities with which the Administrator has concluded appropriate agreements.
9.2. License
By uploading User Content, the User grants the Administrator a license to use this content to the extent necessary to provide the Service.
10. Final Provisions
10.1. Governing Law
These Terms and Conditions are governed by Polish law.
10.2. Dispute Resolution
Disputes will be resolved by Polish courts having jurisdiction over the Administrator's seat. Consumers have the option of using out-of-court dispute resolution methods, including through the EU ODR platform.
10.3. Changes to Terms and Conditions
The Administrator reserves the right to change these Terms and Conditions. Users will be informed of changes at least 7 days before they enter into force. Continued use of the Service after the changes come into force means acceptance of the new Terms and Conditions.
